These Terms of Use govern access to charliesnest.com and the services offered through it. By browsing the website, creating an account or submitting a form, you agree to be bound by these terms and by the Privacy Policy.

2What Charlie'sNest Provides

Charlie'sNest offers home warranty plans. A plan is a yearly service agreement that pays toward the repair or replacement of covered home systems and appliances that fail from normal wear.

A home warranty plan is not an insurance policy. It does not cover loss caused by fire, weather, theft or accidents.

3Eligibility and Accounts

The website is intended for residents of the United States who are eighteen years of age or older. When you create an account, you agree to:

  • Provide information that is accurate, current and complete
  • Keep your password private and your account details up to date
  • Accept responsibility for activity that takes place under your account

Charlie'sNest may suspend or close an account that is used in breach of these terms.

4Plans, Agreements and Fees

The pages of this website describe coverage in general terms. The plan agreement issued at signup is the controlling document. It names the covered items, the term of the plan, the service fee, the coverage limits and the exclusions.

Where the website and a plan agreement differ, the plan agreement applies. Prices and plan features may change for new signups and renewals.

5Service Requests

Service requests are submitted through the website. Each request is reviewed against the plan agreement before a contractor is assigned.

  • A service fee is due for each covered request, as stated in the plan agreement
  • Repairs are carried out by independent local contractors
  • The choice between repair and replacement follows the terms and limits of the plan agreement
  • Work arranged without prior approval may not be reimbursed

6Text Message Communications

With your consent, Charlie'sNest may send text messages about your account, quotes, service requests and renewals, along with separate promotional messages about home warranty plans. Consent to receive text messages is not a condition of purchase.

Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out, or reply HELP for assistance. Mobile carriers are not liable for delayed or undelivered messages.

7Acceptable Use

You agree not to:

  • Use the website for any unlawful or fraudulent purpose
  • Submit false information, or a request on behalf of another person without permission
  • Attempt to gain access to accounts, systems or data that are not yours
  • Copy, scrape or interfere with the normal operation of the website

8Intellectual Property

The text, graphics, logos and layout of this website belong to Charlie'sNest or its licensors and are protected by applicable law. You may view and print pages for personal use. Any other use requires written permission.

9Disclaimers and Limits of Liability

The website and its content are provided as is and as available, without warranties of any kind beyond those stated in a plan agreement.

To the fullest extent permitted by law, Charlie'sNest is not liable for indirect, incidental or consequential damages arising from use of the website. Nothing in this section limits the obligations set out in a plan agreement.

10Arbitration and Disputes

Any dispute arising from these terms or from use of the website will first be addressed through good faith discussion. A dispute that cannot be settled that way will be resolved by binding arbitration on an individual basis, and not as part of a class or representative action, unless applicable law provides otherwise.

These terms are governed by the laws of the State of Ohio, without regard to its conflict of law rules.

Charlie'sNest may update these terms from time to time. The revised version takes effect when it is posted on this page, and the date at the top shows when it was last revised. Continued use of the website after a change means you accept the updated terms.
